Who we are
Factor Connection (thefactorconnection.com, "the site") is operated by Jumpstart, a subsidiary of Kenobi Concepts LLC ("Jumpstart", "we", "us"). By using the site you agree to these terms. If you do not agree, do not use the site.
What Factor Connection is, and is not
Factor Connection is a directory and referral service. It helps businesses find factoring and purchase order financing companies and passes requests to them.
- We are not a lender, a factor, or a loan or factoring broker. We do not buy invoices, lend money, arrange financing, or act as an agent for you or for any listed company.
- We make no funding decisions. Each factoring company decides on its own whether to work with you and on what terms.
- Nothing on the site is financial, legal, tax or accounting advice. Talk to your own advisers before you sign a financing agreement.
No guarantee of approval, rates or terms
We do not guarantee that you will be approved by any company, or that you will receive any particular advance rate, fee, funding speed, credit limit, contract length or other term. Any figures on the site are what a company published or reported at the time, not an offer. Your actual terms are set by the company in a written agreement between you and that company.
Listing information
Company listings are compiled mainly from each company's own website and, for claimed listings, from information the company provides. Companies change their programs, rates and terms, and a listing may be out of date or incomplete. We show the source and date where we can, but we do not warrant that any listing is accurate, complete or current. Check every term directly with the company before you rely on it. If you see something wrong, tell us through our contact page.
How we are paid
The site is free for businesses to use. We receive compensation from some listed companies, for example referral fees, fees for leads, or payments for featured or sponsored placement. Compensation can affect which companies appear first in a list, and paid or partner placements are labeled "Featured" or "Sponsored". It does not change the facts we publish about a company. Requests and lead submissions
When you submit a quote request, a Get Started request or a similar form, you agree that we may share the information you provide with up to three factoring or financing companies, and that we and those companies may contact you about your request by phone, text or email, as described in the consent statement on the form. Each company that receives your information handles it under its own privacy practices. Our handling of your information is described in our Privacy Policy.
You agree that the information you submit is accurate and that you are authorized to request financing for the business you describe.
Factoring companies, partners and advertisers
If you represent a factoring or financing company, claiming a listing, featured placement, lead programs and referral partnerships are governed by separate written agreements between your company and Jumpstart. These terms do not create any such agreement. Claimed listings must be accurate and must not infringe anyone's rights.
Acceptable use
Do not misuse the site. That includes submitting false or fraudulent requests, scraping or copying the site in bulk, interfering with its operation or security, or using it for any unlawful purpose. We may block access or remove content at our discretion.
Intellectual property
The site's text, design, logos and compilation of information belong to Jumpstart or its licensors. Company names, logos and trademarks belong to their owners and are shown only to identify those companies.
Links to other sites
The site links to company websites and other third-party sites. We do not control them and are not responsible for their content, offers or practices.
Disclaimer of warranties
The site and all information on it are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement.
Limitation of liability
To the fullest extent permitted by law, Jumpstart and Kenobi Concepts LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or business, arising from your use of the site or from any dealings with a company listed on it. Our total liability for any claim related to the site will not exceed one hundred U.S. dollars ($100).
Indemnity
You agree to indemnify and hold Jumpstart and Kenobi Concepts LLC harmless from claims arising from your misuse of the site or your breach of these terms.
Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute arising from these terms or the site will be brought in the state or federal courts located in Dallas County, Texas, and you consent to their jurisdiction.
Changes
We may update these terms. The effective date above shows when they last changed. Continued use of the site after a change means you accept the updated terms.
