FloridaCommerce, the state's economic development agency, lists target industries that include aerospace and aviation, agtech, financial services, information technology, life sciences, logistics, manufacturing, maritime, and military and defense. Several of those, especially logistics and maritime, are among the most factoring-intensive sectors anywhere.
The size of the market is large. The Bureau of Labor Statistics' Economy at a Glance table for September 2026 (preliminary) shows about 1,993,400 jobs in trade, transportation and utilities, 1,631,400 in professional and business services and roughly 657,000 in construction. Manufacturing is smaller, at about 428,900, while leisure and hospitality reaches roughly 1,345,300.
Freight leads the factoring demand. Containers moving through Miami, Port Everglades, Jacksonville and Tampa, plus produce trucked north each winter, keep thousands of small carriers and brokers busy. See freight and trucking factoring for how load-by-load funding works. Import and export trading companies dealing with Latin America add cross-border receivables; our international factoring page covers export credit issues.
Construction is the second pillar. Specialty subcontractors in a market shaped by population growth and hurricane rebuilding wait on progress payments and retainage. Staffing firms supplying hospitality, healthcare and construction labor, and defense contractors serving the state's military installations, round out the list.
Four listed factoring companies are headquartered in Florida, all in the Miami area. eCapital's freight factoring arm is based in Aventura and advertises advances up to 100% with funding in as little as an hour. Summar Financial in Miami, founded in 2004, publishes average fees of 1% to 3% and funds freight, staffing payroll and Latin American export receivables. Factoring Express in Sunny Isles Beach advertises advances up to 97%, no contracts and no monthly minimums across trucking, staffing, healthcare, government and contractor invoices, and owns a trucking company and a brokerage of its own. EZ Factoring in Miami is listed without verified terms. Florida's port and produce freight is also served by the national factors in the comparison table below.
Florida is unusual: UCC filing was privatized. According to the Florida Department of State, Division of Corporations UCC information page, the UCC filing process was privatized to Image API, LLC on October 1, 2001. The vendor handles filings, forms, photocopy and certification requests, and database availability, through the Florida Secured Transaction Registry. The Department of State page directs filers to the registry for forms, filings, searches and copies, and lists the vendor's Tallahassee mailing and courier addresses.
The registry is the place to search before you sign with a factor. Enter your exact legal entity name and look for financing statements covering accounts, receivables or all assets. Merchant cash advance providers are active in Florida, and their filings often claim future receivables, which can block or complicate a factoring arrangement.
Your factor will file its own UCC-1 in the registry once you sign. Under Article 9, the buyer of accounts perfects its ownership by filing, so the UCC-1 is what protects the factor against other creditors and a bankruptcy trustee.
Factoring is generally structured as a purchase of receivables rather than a loan. Florida's legislature addressed the point directly in its disclosure statute: under Fla. Stat. § 559.9611, for purposes of that part, a provider's characterization of an accounts receivable purchase transaction as a purchase is conclusive that it is not a loan or a transaction for the use, forbearance or detention of money.
That definition is part of the Florida Commercial Financing Disclosure Law (Part XIII of Chapter 559). It defines an accounts receivable purchase transaction as the sale of a business's accounts or payment intangibles at a discount, which describes factoring. Under § 559.9612 the law applies to commercial financing transactions consummated on or after January 1, 2024, and does not apply to, among others, federally insured depository institutions, providers that consummate no more than five commercial financing transactions in Florida in a 12-month period, or transactions of more than $500,000.
Florida's Article 9 anti-assignment override appears at Fla. Stat. § 679.4061, which makes a term in an agreement between an account debtor and an assignor ineffective to the extent it prohibits, restricts or requires consent to the assignment of an account.
This is general information, not legal advice.
Miami, Fort Lauderdale and West Palm Beach form the largest market, driven by international trade, ports, cruise and hospitality, healthcare and construction.
Tampa and St. Petersburg combine a working port, defense and military contracting, financial back offices and distribution.
Orlando adds tourism, simulation and training contractors serving the military, and a fast-growing construction sector.
Jacksonville is a logistics center, with container terminals, rail yards, naval installations and trucking along Interstates 95 and 10.
Tallahassee and the Panhandle rely on state government, military bases and timber and agricultural shipping.
It covers accounts receivable purchase transactions, which is how factoring is defined in § 559.9611, for transactions consummated on or after January 1, 2024. Exemptions include depository institutions, very small providers and transactions over $500,000. If you fall within the law, expect a written disclosure of key terms before closing.
With the Florida Secured Transaction Registry, run by a private vendor under contract with the Department of State since October 1, 2001. Searches, filings and copies all go through the registry rather than the Division of Corporations' business entity database, so check both if you are researching a company.
