Factoring in Georgia

The Georgia Department of Economic Development lists twelve key industries: aerospace, agribusiness and food processing, arts, automotive and electric vehicles, energy, film, life sciences, logistics, manufacturing, music, technology and tourism. The same page describes the state as a premier logistics hub with multimodal connections by ground, sea and air.

Those connections show up in the employment data. The Bureau of Labor Statistics' Economy at a Glance table for September 2026 (preliminary) counts about 1,032,700 jobs in trade, transportation and utilities, by far the largest private category, followed by about 749,100 in education and health services and 741,000 in professional and business services. Manufacturing accounts for roughly 426,800 jobs.

Freight is where most Georgia factoring begins. Drayage carriers serving the Port of Savannah, long-haul fleets running Interstates 75, 85 and 16, and freight brokers based in metro Atlanta all live with 30- to 60-day payment terms. See freight and trucking factoring for how carriers use it.

Manufacturing and agribusiness add more. Poultry processors, carpet and flooring mills in the northwest, and a growing set of automotive and battery suppliers buy inputs well ahead of payment. The state's film and television production industry creates another distinctive market: equipment rental houses, set builders and post-production vendors that bill studios and productions on net terms. Staffing firms supplying warehouses and plants complete the picture; see staffing factoring.

Factors based in Georgia

Two listed factors are headquartered in Georgia, both in metro Atlanta and both freight-focused. OTR Solutions in Roswell is one of the largest freight factors in the country, with instant 24/7 payouts to any bank account, a fuel card and its "True Non-Recourse" program; its terms include a 90-day notice period and an approved-broker network. Treadstone US Capital in Marietta describes itself as a boutique, full-service factor with same-day funding by EFS card, wire or ACH, recourse and non-recourse options and weekend fuel advances; it publishes no rate. Georgia's Savannah drayage and Atlanta distribution carriers are also served by the national freight factors in the comparison table below.

UCC filings in Georgia

Georgia does not use a single state filing office. A UCC financing statement is presented to the clerk of superior court in any Georgia county, and the Georgia Superior Court Clerks' Cooperative Authority (GSCCCA) maintains the statewide index. According to the GSCCCA's UCC system page, legislation passed in 1993 created the central index, so a secured party need only file in one county to receive statewide notice. The local clerk has 24 hours to transmit the document to the Authority, which then has 24 hours to add it to the index.

The GSCCCA provides free statewide search access through terminals installed in every clerk of superior court office, and online access is available by subscription. The same page links to the Authority's UCC administrative rules, filing checklists and fee schedule.

A factor buying your receivables will file a UCC-1 through a county clerk naming your business and describing accounts. Article 9 uses that filing to perfect the purchase against your other creditors. Before you sign, search the statewide index for your exact legal name and any trade names, and look for filings covering accounts or all assets.

Georgia law notes

Factoring is generally structured as a purchase of receivables rather than a loan. Georgia's 2023 commercial financing legislation reinforces that framing for certain purposes: Senate Bill 90 (2023) added a Code section providing that, for purposes of Chapter 1 of Title 7, a provider's characterization of an accounts receivable purchase transaction as a purchase is conclusive that it is not a loan.

SB 90 also created Georgia's commercial financing disclosure requirements. According to a law-firm summary of the enacted law, it applies to covered commercial financing transactions of $500,000 or less consummated on or after January 1, 2024. The bill's exemptions include providers that consummate five or fewer commercial financing transactions in the state during any 12-month period, transactions secured by real property, and transactions over $500,000. A factoring or purchase arrangement involving receivables owed to a healthcare provider for a patient's personal injury treatment is also excluded.

Georgia's Article 9 includes the UCC 9-406 rule that generally makes customer contract terms prohibiting assignment of accounts ineffective.

This is general information, not legal advice.

Major metro areas

Metro Atlanta dominates, with a major international airport, rail hubs, distribution centers along the perimeter and interstates, corporate headquarters, film studios and a deep services sector.

Savannah is anchored by its container port and the warehouses, drayage carriers and manufacturers that cluster around it.

Augusta combines a major Army installation, cybersecurity contracting, healthcare and manufacturing.

Columbus and Macon add military, insurance, manufacturing and logistics activity in central and west Georgia.

Dalton in the northwest is the center of the flooring industry, with mills and suppliers that sell to distributors and retailers nationwide.

Frequently asked questions

Where do I file or search a UCC in Georgia?

Filings are made with any county clerk of superior court, and the GSCCCA indexes them statewide. Searches are free on terminals in every clerk's office, or online by subscription. You do not need to search all 159 counties separately, because the central index covers filings statewide.

Does Georgia's SB 90 disclosure law apply to my factoring deal?

It can. The law covers commercial financing transactions, including accounts receivable purchases, of $500,000 or less consummated on or after January 1, 2024, unless an exemption applies. Ask your factor whether it treats your deal as covered and request the disclosure before you sign.

Can Georgia film production vendors factor invoices?

Many do. Equipment rental houses, set construction shops and post-production vendors often bill productions that pay on 30 to 60 days. Factors will want to understand who ultimately pays, a studio or a single-purpose production company, since that affects credit risk. Compare costs with the factoring calculator.
